It sounds like he's in the key of E using open D tuning capo on 2nd fret. I assume he would not tune a 12 string to open E, and the high melody note he keeps hitting certainly has the ring of a 1st string 4th fret.
To be sure, I'll ask one of my friends who's in the Tab Pigs. They're a Leo Kottke Fan group who write tab for Leo's stuff.
